Canada's New Policy Empowers Hong Kong Permanent Residence Applicants

Canada’s New Policy Empowers Hong Kong Permanent Residence Applicants

In a significant move, Canada has unveiled a new policy aimed at supporting Hong Kong permanent residence applicants. The policy, announced on May 7, 2024, offers a pathway for applicants to extend their status and acquire an open work permit while their permanent residence applications are being processed.

Empowering Hong Kong Residents

Canada’s commitment to supporting the freedom and democracy of Hong Kong nationals remains unwavering. With the recent announcement, Canada underscores its dedication to standing by Hong Kong residents during these challenging times. By closely monitoring the situation in Hong Kong, Canada ensures that its immigration policies remain attuned to the evolving needs of Hong Kong residents seeking refuge in Canada.

Addressing Processing Delays

Since the launch of the pathway to permanent residence for in-Canada Hong Kong nationals in 2021, the influx of applications has led to extended processing times. Many applicants face the imminent risk of their temporary status in Canada expiring before their permanent residence applications are finalized. Recognizing this pressing issue, Canada has introduced a proactive measure to alleviate the concerns of applicants awaiting decisions on their residency status.

Key Provisions of the New Policy

Effective from May 27, 2024, the new policy extends open work permits to applicants under Stream A (in-Canada graduates) or Stream B (Canadian work experience) of the temporary public policy for Hong Kong residents in Canada. To be eligible, applicants must have held a work or study permit in the three years preceding their application for permanent residence. This initiative is set to span five years, allowing applicants to maintain their temporary status in Canada while awaiting the outcome of their permanent residence applications.

Streamlined Application Process

Under the new policy, applicants or their guardians are responsible for renewing their status as required. By applying to extend their work or study permit before the current permit expires, applicants can ensure the continuity of their legal status in Canada through “maintained status.” Moreover, applicants whose temporary status expired within the 90 days preceding their application for a new open work permit can utilize this public policy to restore their status concurrently. However, applicants whose temporary status lapsed more than 90 days before applying for the new open work permit will not qualify for approval under this provision.

As the new policy takes effect, it offers hope and assurance to Hong Kong permanent residence applicants, underscoring Canada’s status as a welcoming and compassionate nation on the global stage.
